General Terms of Use and Purchase

1. General provisions
These General Terms govern the use of the website thecodegym.com and the purchase of services of the private fitness studio The CODE: ordering, payment, provision of the service, cancellation, refunds and complaints, copyright protection and general provisions. The seller and service provider is Gym&Acro, sports services sole proprietorship, owner Roko Lozić, Rovinjska ulica 3, 10000 Zagreb, Croatia, OIB (tax no.) 85792875234. The buyer is a person who registers on the website, orders a service and pays for it by debit/credit card or with package credits. These Terms are published in Croatian and English; in case of discrepancy, the Croatian text prevails.
2. The service
The CODE offers sessions in a private fitness studio at Rovinjska ulica 3, Zagreb. Each session lasts 55 minutes and is intended for at most two people: a single session takes one spot, a pair session takes both. Besides single sessions we sell credit packages; one credit is worth one spot in a session. The name, description and price of every service are shown on the website before you order.
3. Ordering
You need a user account on the website to order. The buyer chooses an open slot or a credit package, reviews the order summary (service, code, unit price, quantity and total), enters billing details, accepts these Terms and pays. The order becomes binding and the contract is concluded when the bank approves the payment; a session paid with credits is booked when the booking is confirmed. After a successful payment the buyer receives an order confirmation and an invoice by e-mail.
4. Prices and payment
All prices are in euros (EUR) and are final; no additional fees are charged for payment. Exempt from VAT under Article 90(1) of the Croatian VAT Act, so no VAT is included in the price. Services are paid online by Visa, Mastercard® and Maestro® debit/credit cards or with package credits. The debit/credit card is charged in euros when the payment is confirmed, with 3-D Secure verification by the bank that issued the card. Payments are processed by the payment service provider Monri Payments d.o.o.; we never see or store debit/credit card details. Payment security and currency conversion are described on the Payment Security page. A single session uses one credit, a pair session two, because it takes both spots. Package credits are valid for one year from the date of purchase; unused credits expire at the end of that period.
5. Provision of the service
The service is provided only at The CODE studio, Rovinjska ulica 3, 10000 Zagreb, Croatia, in the booked session, so there is no shipping and no shipping cost. A booking is confirmed as soon as the payment is approved, and package credits are available on the user account immediately. The user enters by scanning the QR code on the door (opening from the app, at most five times per session) or with a one-time PIN code for the smart lock. Entry is possible from 5 minutes before the session starts until it ends. Statement on export restrictions: the service is neither exported nor shipped, so there are no known export restrictions or customs regulations that apply to it.
6. Cancellation and rescheduling
Free cancellation is possible up to 24 hours before the session starts, with the credit returned to the user account; within the same period the booking can be moved to another open slot. After that the session is not refunded and cannot be moved. Exception: within the first hour after booking, cancelling and rescheduling are free no matter how close the session is, but only until entry opens (5 minutes before the start). Once entry is open, the session counts as started and can no longer be cancelled or moved. A pair session returns two credits, because two spots were paid for. If the studio cancels a session, the buyer gets the credit back (two for a pair session). Being late does not move the end of the session.
7. Refunds
If you cancel more than 24 hours before the session, you receive a credit or move the booking to another open slot; money is not refunded in that case, and the value stays on your account as a credit valid for one year. If a session cannot be confirmed after the payment was approved (e.g. because it filled up or was closed in the meantime), we will contact you and offer a replacement session or a credit; if you do not accept them, we refund the full amount within 14 days at the latest. Money is refunded only to the debit/credit card used for the payment; when the funds appear on your account depends on the bank that issued the card.
8. Complaints
The buyer has the right to file a written complaint: by e-mail to info@thecodegym.com, by post to Gym&Acro, Rovinjska ulica 3, 10000 Zagreb, or in person at the studio. We confirm receipt of a complaint without delay and send a written reply within 15 days of receipt at the latest. All details, including out-of-court dispute resolution, are on the Complaints page.
9. Liability and safety
The user uses the equipment at their own risk and must follow the studio rules. The studio is not liable for injuries caused by improper use of equipment. The user is responsible for people they bring to their session.
10. Copyright protection
The content of thecodegym.com (texts, photographs, The CODE logo, graphic design and program code) is protected by copyright and other intellectual property rights of Gym&Acro or third-party right holders. Buyers and visitors agree not to reproduce, modify, publish or otherwise use that content without the express written permission of the right holder, except for personal, non-commercial use.
11. Governing law and jurisdiction
These Terms and contracts concluded through the website are governed by the law of the Republic of Croatia. We try to resolve disputes amicably, through a complaint and, if needed, before a consumer alternative dispute resolution body. If a dispute cannot be resolved amicably, the competent court in Zagreb has jurisdiction, unless mandatory consumer protection rules provide otherwise.
12. Final provisions
Gym&Acro reserves the right to change these Terms. Users are notified of material changes by e-mail, and orders that are already paid remain subject to the Terms valid at the time of the order. The buyer is responsible for the accuracy and completeness of the data entered at registration and purchase. The costs of internet access and of the equipment used to access the website are borne by the user.
